Promotional lottery

A promotional lottery is a promotional operation in which the winner is selected by chance, with no test of merit, in order to promote a product, a service or a brand. Its legal regime varies between Member States, and participation must in principle remain free of charge for the consumer.

A promotional lottery is a game in which luck alone determines the award of prizes: prize draw, instant win, wheel or scratch card. It is used to liven up a campaign, gather contacts or boost footfall. At European level, Directive 2005/29/EC on unfair commercial practices prohibits, among other things, leading a consumer to believe that they have already won when claiming the prize requires a payment or a cost. For the rest, each Member State applies its own rules. In France, lotteries are subject to national conditions, and the promotional lottery is only allowed under conditions, notably the absence of any financial sacrifice for the participant and the availability of official rules. These points must be checked against the text in force at the time of the operation. Practical example: a restaurant offers a prize wheel, accessible by QR code on the tables. Each customer can play without any additional purchase being imposed, and the prizes are limited by a defined prize pool. Common mistakes: requiring a purchase in order to play, failing to describe the prizes precisely, forgetting the free alternative ways to take part, or mixing lottery and skill test without clarifying the mechanism. QronoPlay lets you configure these games of chance and frame the prizes, but the legal classification of the operation remains the responsibility of the organiser and its legal adviser.
